LEASE OPERATORS :  IF YOU CAN ANSWER YES TO THE FIVE QUESTIONS BELOW YOU CAN DEPRECIATE YOUR LEASED VEHICLE:

o   Did the title to the property go in your name

o   Did you have  a legal obligation to pay for the  property

o   Did you have a responsibility to pay maintenance and operating expenses

o    Did you  or are you responsible to pay taxes on the property

o   Did you accept reponsiblity if the property is destroyed, condemned or diminished in value through obsolescence or exhaustion and will have to pay compensation over and above what an insurance policy might cover

If you answered yes then you can depreciate your rig just like the owner/operators.  According to Page 4 of Publication 946 from the IRS.
